This month, Eric Epstein of Rock the Capital submitted a request for information under the Right-to-Know Act. This request concerned the Creative Director position with the Senate of Pennsylvania. Specifically, Mr. Epstein sought information about the job description and all financial remunerations associated with the position.

A reply from Donetta M. D’Innocenzo, of the Open Records Office, arrived today. The reply cites Section 902 of the Act, which states that timely responses may be delayed due to staffing limitations.

Dear Mr. Epstein,
I am responding to your recent RTK request which was received on Monday May 18, 2020 in which you requested the following:
1) Please provide the job description and salary band for Danielle Floyd Prokopchak, Creative Director, Senate of Pennsylvania.
2) Please provide the transaction type, voucher number, Payee/Description, account and amount for per diems incurred and paid to Senate members from January 1, 2019 to December 31, 2020. [Updated to December 31, 2019]
3) Please provide the transaction type, voucher number, Payee/Description, account and amount for per diems incurred and paid to Senate members from January 1, 2020 to April 30, 2020.
4) Please provide the transaction type, voucher number, Payee/Description, account and amount for expenses incurred and paid to Senate members from January 1, 2019 to December 31, 2020. [Updated to December 31, 2019]
5) Please provide the transaction type, voucher number, Payee/Description, account and amount for “expenses” incurred and paid to Senate members from January 1, 2020 to April 30, 2020.
Section 902 of the Right-to-Know law provides for an extension of time of up to 30 days to respond to the request if any of seven reasons enumerated in Section 902(a) of the Act apply. If so, the open records officer shall send written notice to the requester within five business days of receipt of the request for access. 65 P.S. §67.902.

As provided by Section 902, I am hereby notifying you that an extension is necessary to respond to your request for the reason indicated below.

§902(a)(3) a timely response to the request for access cannot be accomplished due to bona fide and specified staffing limitations;

I expect to have a response to you within the 30 day extension window provided for in Section 902, with an extension due date of July 2, 2020.
